科学と科学の応用の進歩から利益を得る権利（「科学に対する権利」）は，1948年という早い時期に認められていたにもかかわらず，国際法学者や国際法実務家を長い間困惑させてきた。科学，技術，社会の関係を適切に組み立てる上で重要であるにもかかわらず，科学に対する権利は依然として十分に理解されておらず，その恩恵を受けうる人々によって行使されることは極めて稀である。
